Brand Ambassador Program
Brand Ambassador Terms & Conditions
Thanks for considering our brand ambassador program! Our company is dedicated to providing the best experience for its customers. Since we don’t know every one of our ambassadors personally, we’ve created some terms to set everybody’s expectations.
When we say “Company”, “we”, “our”, or “us” in this document, we are referring to LUCKY+DOG.
When we say “Services”, we mean any product created and maintained by the Company.
These terms may be updated at any time. We will let you know by email, and continuing in the program after an update means you accept the new terms.
Please read this document in its entirety before accepting to become a brand ambassador of the Company.
Eligibility
To become an ambassador of the Company, you must:
- Be 18 years of age or older
- Have read, understood, and agreed to these terms
- Be in good standing with the Federal Trade Commission (FTC)
- Own active social media accounts where you will share the Company with your own audience
One Account Per Person
- Each person or business may hold one ambassador account and one promo code.
- Each payout account (such as a PayPal email) may be linked to one ambassador account only.
- If you run more than one website or social account, list them all under your single ambassador account.
- Accounts that share a payout account, or that we believe are run by the same person, may be closed together.
Your Promo Code
- Your promo code must include your name or your social media handle, for example SARAH10 or LUNATHEDOODLE.
- Codes made of generic words that shoppers might guess at checkout, such as WELCOME, SAVE, SALE, DEAL, DISCOUNT, FIRST, NEW, DOG, or LUCKY, are not allowed.
- We may rename, deactivate, or replace any code that does not follow these rules, at any time.
Engagement
As a brand ambassador of the Company, you agree to:
- Create, post, and share content that promotes the Company’s services
- Promote your unique promo code to your own audience to increase sales for the Company
- Collaborate with other ambassadors when required
- Occasionally attend events, if requested by the Company
Restrictions
As a brand ambassador, you agree not to:
- Post, submit, or share your promo code on coupon, deal, discount code, voucher, or cashback websites, apps, or browser extensions (such as Honey, RetailMeNot, Capital One Shopping, or similar)
- Create or use websites whose main purpose is listing discount codes or affiliate links
- Create multiple ambassador accounts or use more than one promo code
- Use your own promo code on your own purchases, or ask friends or family to place orders so that you earn commission
- Run any paid advertising with your promo code, or bid on the Company’s name in search ads
- Make any guarantees, representations, or warranties on behalf of the Company, other than the ones provided in the marketing material
- Spam or promote the Company in a way that violates any laws or regulations
- Promote the Company in any sexually explicit, violent, political, discriminatory, unlawful, threatening, illegal, or otherwise objectionable content, subject to the sole direction of the Company
- Use the Company’s brand, image, or likeness on your own website in a way that creates customer confusion
- Engage in any fraudulent activity that would artificially affect sales or social media metrics such as, but not limited to, likes, follows, shares, and views
- Misrepresent or modify the price of the Company’s services
The Company reserves the right to request removal or modification of any ambassador content in its sole discretion.
Disclosure
The ambassador agrees to disclose the material connection between them and the Company. The ambassador may use text such as “#sponsored” or “#ad” to disclose this relationship. The disclosure should be clear and follow all guidelines by the Federal Trade Commission (FTC).
Compensation
- The ambassador will be paid 7% of every eligible sale generated through their promo code. Commissions are paid on the net sale, which means after discounts are applied and before sales taxes and shipping are charged.
- Commissions on orders that are cancelled, refunded, or returned will be reversed.
- The Company may withhold, reverse, or cancel any commission earned in a way that breaks these terms, including sales from codes posted on coupon sites, duplicate accounts, or your own purchases. This applies to pending commissions and to any later commissions on the same account.
- This percentage is subject to change by the Company at any time.
- The ambassador is solely responsible for any and all tax obligations.
Intellectual Property Rights
Ambassador content: The ambassador grants the Company a worldwide, irrevocable, sublicensable, nonexclusive license to use the content the ambassador creates to promote the Company’s services, in any manner, in whole or in part, in perpetuity. This includes, but is not limited to, social media, advertising, publications, marketing material, or any other form of media.
Company content: The Company grants the ambassador a nonexclusive, nontransferable, revocable, limited license to use the Company’s name, logo, slogans, promo codes, likeness, and other advertising material solely for the purpose of this ambassador agreement. The Company retains all rights to its content.
Termination
- The Company may terminate the relationship with the ambassador at any time for any reason, with or without cause.
- If an account is closed for breaking these terms, any unpaid commissions on that account are forfeited.
- The ambassador may terminate the relationship with the Company with 30 days written notice.
Competing Products
While an ambassador of the Company, the ambassador may not promote or advertise competing products.
Liability Limitations
You expressly agree and understand that the Company shall not be liable to you or any third party for any direct, indirect, consequential or any other damages including, but not limited to, damages for loss of profit, goodwill, or other intangible losses resulting from the ambassador program.
